By working with The Social Sidekick, Six Point Media or using our website, you agree to the terms below.

Terms & Conditions of Service

These Terms & Conditions apply to all services delivered by Six Point Media Ltd ("SPM"). By engaging our services, you agree to the following terms.

1. GENERAL TERMS (Applies to All Services)

1.1 Payment Terms

  • All recurring monthly payments must be made by the last Friday of each month, covering the following calendar month.

  • Failure to pay on time will result in suspension of services.

  • Due to the nature of our business, all payments are non-refundable once made.

1.2 Notice & Termination

  • A minimum of 30 days written notice is required to terminate services.

  • If termination occurs during a fixed-term contract, the remaining contract balance is payable in full.

  • If no notice is given before the end of a Statement of Work (SOW), the agreement will automatically move into a rolling monthly contract, requiring 30 days’ notice to terminate.

  • Either party may terminate with 30 days’ written notice. Fees will be payable only for services delivered up to the termination date unless within a fixed-term agreement.

1.3 Confidentiality

SPM acknowledges that during the course of engagement, we may become aware of confidential information including (but not limited to):

  • Customer data

  • Marketing strategies

  • Financial information

  • Project documentation

  • Business operations

  • Personal information

SPM agrees to maintain strict confidentiality and protect all information obtained during the engagement.

Nothing in this agreement limits liability arising from:

  • Breach of confidentiality

  • Data protection violations

  • Unauthorised publication of confidential materials

1.4 Liability

  • SPM is not liable for third-party costs including (but not limited to) advertising spend, media budgets, location hire fees, travel to locations, models, actors, influencers & any other impact to the business outside of our confirmed scope of work.

  • SPM is not responsible for platform algorithm changes, ad account restrictions, or performance fluctuations outside our control.

2. CONTENT PRODUCTION SERVICES

(Filming, Photography, Editing, Asset Creation)

2.1 Ownership

Unless otherwise agreed in writing:

  • All RAW assets remain the property of Six Point Media.

  • Upon full payment, ownership of edited deliverables transfers to the Client.

  • SPM may retain copies solely for delivery, portfolio & marketing use (unless restricted in writing), and archival purposes.

2.2 Delivery Timelines

  • Content delivery can take up to 14 business days from the date of shooting, unless otherwise agreed in writing.

2.3 Revisions

  • Two full rounds of revisions are included per project.

  • All revisions must:

    • Be submitted via email

    • Be clearly written

    • Include timestamps

Revisions submitted via WhatsApp, phone call, or verbal instruction will not be registered.

Additional revisions beyond the included two rounds will be charged separately.

2.4 Brief Sign-Off

  • All edits require a written brief to be signed off by the Client before production begins.

  • If edits are executed exactly according to the approved brief, but the Client later changes direction, a reshoot and/or full re-edit will be subject to new payment terms.

3. SOCIAL MEDIA MANAGEMENT & MARKETING SERVICES

3.1 Content Approval

  • All content must receive written approval before publication.

  • If approval delays occur, SPM is not responsible for missed posting schedules.

3.2 Brand Usage & Public Association

  • Any public use of the Client’s name, brand, content, or association must receive prior written approval.

  • Likewise, any public use of SPM’s name or brand must be approved in writing.

3.3 Advertising & Media Spend

  • All advertising budgets are separate from SPM management fees.

  • Media spend is paid directly by the Client unless otherwise agreed.

  • SPM does not guarantee specific results (sales, leads, reach), as performance depends on multiple external variables.

4. WEBSITE & BRANDING PROJECTS

4.1 Project Scope

  • Deliverables will be defined in the Statement of Work (SOW).

  • Work outside the agreed scope will be quoted separately.

4.2 Revisions

  • Two rounds of revisions are included per project phase.

  • Additional revisions are chargeable.

4.3 Access & Hosting

  • The Client must provide all necessary hosting, backend credentials, and technical access before work can commence.

  • Delays in providing access may extend project timelines.

5. INTELLECTUAL PROPERTY & USAGE

  • Ownership of final deliverables transfers upon full payment unless otherwise specified.

  • SPM reserves the right to use completed work in its portfolio, case studies, and marketing materials unless otherwise agreed in writing.

  • RAW files are not included unless explicitly stated in the SOW.

6. Acceptance

By signing a Statement of Work or making payment, the Client acknowledges acceptance of these Terms & Conditions.
